PLEASE CAREFULLY READ THE FOLLOWING TERMS, THE TERMS AND CONDITIONS OF USE AND THE PRIVACY POLICY WHICH ARE HEREBY INCORPORATED BY REFERENCE. BY INDICATING YOUR AGREEMENT TO BE BOUND BY THESE TERMS AND CONDITIONS OF PURCHASE AND THE TERMS OF USE AND TO THE COLLECTION, USE AND DISCLOSURE OF YOUR PERSONAL INFORMATION IN ACCORDANCE WITH THE PRIVACY POLICY, AND YOU ENTER INTO A LEGALLY BINDING AGREEMENT WITH ZAVIDA COFFEE COMPANY INC.

Order Acceptance

Only residents of Canada and the US who have reached the age of majority in their province and/or state of residence may place orders through the Sites. Product orders are available to be shipped within Canada and the US only.

 

The receipt of an email order confirmation does not constitute the acceptance of an order or a confirmation of an offer to sell. Such receipt also does not constitute a confirmation that the product is in stock or otherwise available on the price and terms published on the Site or other advertisements. Your order will be deemed to be accepted only if and when we send a shipping confirmation of the terms of your order to your email address and will be subject to these Terms of Purchase and the additional terms and conditions included in your order.

 

Zavida reserves the right, without prior notification, to limit the order quantity on any item and/or to refuse service to any User for any reason, including limitations and corrections on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified as potential fraud. Zavida reserves the right to limit the number of items purchased per person, per household or per order for any reason; and these restrictions may apply to orders placed by the same account, the same credit card, and also to orders that use the same billing address and/or shipping address. Verification of order and customer information may be required prior to the acceptance of any order. Zavida is not obligated to fulfill any order and may refuse any order. Alternatively, Zavida may accept the order and notify the Customer of an estimated time for shipment (in which case the order shall be deemed to remain open until delivery).

Price; Taxes

Items purchased with a promotional discount are not eligible for price adjustments. See the offer associated with the specific promotion for details. We will not make price adjustments on online purchases for items featured in any clearance pricing events.

Taxes

If applicable, the sales tax rate applied depends on your ship-to destination, where the tax is calculated on the total order, and in some provinces, sales tax is payable on shipping and handling charges. If you return an item for a refund, you will also receive a refund for the sales tax you paid for that item.

 

You will not receive a refund for the sales tax you paid on the shipping and handling of that item, as the shipping and handling charges are nonrefundable once an item has been shipped.

Product Availability

Zavida makes every effort to ensure that all of the merchandise we feature is in stock. In the event that an item becomes out of stock after your order is submitted, we will ship the rest of the items in your order and send you an email indicating that one of your selected items is out of stock. You will not be charged for the out of stock item. We will not ship the item when it is back in stock, as we do not have a backorder system.

Shipping; Delivery; Returns

Our shipping process and options that you may have with regard to shipment, including delivery method, carrier and estimated date of delivery or time for delivery, are described during the purchase process, but we reserve the right to use a substitute carrier for your purchase at any time, at our discretion.

 

In the event of an authorized return of any goods sold from the Site, Zavida is not obligated to include a refund of any shipping and handling charges except when the return is for defective product and Zavida shall have the option to refund any amount owing to Customer by either crediting the charge card used for payment or mailing a check to the Customer at the address shown on the related order.

Method of Payment

You can pay for any purchase you make online by using a MasterCard or VISA, or by using a PayPal account. By submitting your payment by credit card, you authorize Zavida to charge the applicable card for the total amount of your order and you represent and warrant that you are the cardholder of the applicable card. If your card is rejected by the card issuer, your order will not be accepted, and Zavida will have no obligation to fulfill your order.

Promotions; Exclusions & Restrictions

Occasionally, Zavida will offer promotions through emails and advertisements. You will always receive free shipping on orders over $65. As a registered member of Zavida.com and Zavida PERKS, you may be eligible from time to time to receive email-exclusive promotions that may include redeeming codes.

Redeeming Coupons

To redeem a Zavida coupon with a valid alpha-numeric coupon code, place all items you would like to purchase in your shopping basket. Redeem your coupon by entering the code in the promotion code field during the Cart or Checkout process and then click "apply." Online promotion codes are not case sensitive. If the coupon code is valid, the applicable discount or promotion will appear in the shopping basket.

 

All promotion codes are available for a limited time, while supplies last and cannot be used once expired. These promotions are not redeemable for cash and are limited to one promotion per order, and in some cases, promotions can only be redeemed once per person. Promotion code stacking/multiple is not eligible for any orders and is automatically set to be prohibited on the Site.

Return Value

All applicable promotions, offers, discounts, and coupons applied at the time of purchase will be prorated and deducted from the number of refunds or credits, including loyalty points.

Errors

In the event that a product is mistakenly listed at an incorrect price on the website, Zavida Coffee Company reserves the right to refuse or cancel any orders placed for product listed at the incorrect price whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Zavida Coffee Company shall issue a refund to your credit card account in the amount of the incorrect price.

Exclusion of Damages; Limitation of Liability

UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, WHETHER IN TORT, CONTRACT, OR OTHERWISE, WILL ZAVIDA COFFEE COMPANY INC. BE LIABLE TO USER FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OF ANY CHARACTER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, LOST PROFITS, LOST SALES OR BUSINESS, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, LOST DATA, OR FOR ANY AND ALL OTHER DAMAGES OR LOSSES, EVEN IF ZAVIDA COFFEE COMPANY HAS BEEN ADVISED, KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES.

 

UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, WHETHER IN TORT, CONTRACT, OR OTHERWISE, WILL ZAVIDA COFFEE COMPANY INC. BE LIABLE TO USER FOR ANY SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THE SERVICES, MATERIALS OR PRODUCTS ON THIS SITE OR THE PERFORMANCE OF THE MATERIAL OR PRODUCTS, EVEN IF ZAVIDA COFFEE COMPANY INC. HAS BEEN ADVISED, KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES.

 

THE PROVISIONS OF THIS SECTION ALLOCATE THE RISKS UNDER THIS AGREEMENT BETWEEN THE PARTIES, AND THE PARTIES HAVE RELIED ON THE LIMITATIONS SET FORTH HEREIN IN DETERMINING WHETHER TO ENTER INTO THIS AGREEMENT.
